Contest Name: Hooligans Sweetheart Contest (herein defined as the “Contest”)
Station(s): WERO-FM (herein defined as the “Station”)
1. Description of Contest/Participation. Listeners will be invited to submit a photo (no older than one (1) year old) of themselves at bob933.com. The following information must be submitted: The name of the person in the picture, their address, telephone number and birthday. Entries will be accepted February 1, 2010 till February 7, 2010. By sending in a picture, the participant is releasing the station to use name and likeness for on-air promotions and on the website.
A. Dates of Contest:
Starting Monday, February 1, 2010 and ending Sunday, February 7th, 2010 pictures may be submitted and posted on bob933.com web site. Beginning February 8th, 2010 listeners will have the opportunity to go to bob933.com and vote for their favorite picture one time per day, per IP address. This process will continue until 10amFebruary 12, 2010. At approximately 10:01amFebruary 12, 2010 the top ten photos with the most votes will be submitted to the judges of HooligansMusic Hall for review. HooligansMusic Hall will select five (5) finalists from the top ten photos with the most votes based on camera friendly nature of the subject, originality and photo quality.
The five (5) finalists chosen based on the number of votes will be invited to appear, free of charge, at HooligansMusic Hall, 2620 Onslow Dr, Jacksonville, NC on February 13th, 2010 to compete for the title of Miss Hooligans Sweetheart 2010. The winner will be selected based on crowd response. The final decision will be at the discretion of the Hooligans Judges. The winner of the Hooligans Sweetheart Contest will receive one (1) 3 month membership including tanning to Gold’s Gym of Jacksonville, NC, one (1) spa package including: a pedicure, manicure, and facial courtesy of Deluxe Day Spa of Jacksonville, NC, a gift certificate from Designer Tan of Jacksonville, NC, flowers and sash provided by Hooligans Pub and Music Hall. Must be able to attend the main event on February 13th, 2010 to be eligible as a finalist. Must be present to win.
NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of participants.
B. How to Enter: Only one way to enter:
• Beginning approximately February 1, 2010 log onto the Station's website at www.bob933.com and follow the Contest links to register. Deadline for online registration is on or about 11:59 p.m. on February 7, 2010. All entries must include your name, address, telephone number, date of birth, and photo.
The station may choose to add additional methods of entry at any time
Valid contest entries must contain all information requested. Incomplete and/or multiple entries will be disqualified.
Participants must be at least 18 years of age (as of 2/01/10) or older at the time of entry and must be submitted the person in photo only. The photo must be no more than 1 year old and must include the contest entrant only.
BY ENTERING THE CONTEST, YOU ARE VERIFYING THAT (1) YOU ARE THE OWNER AND PRODUCER OF THE SUBMITTED MATERIAL AND THAT NO THIRD PARTY OWNERSHIP RIGHTS EXIST TO THE PHOTO SUBMITTED. BY SUBMITTING YOUR PHOTO IN THIS CONTEST, YOU HEREBY GRANT US A PERPETUAL, WORLDWIDE, NON-EXCLUSIVE, ROYALTY-FREE, SUB-LICENSABLE (THROUGH MULTIPLE TIERS) RIGHT AND LICENSE TO USE, PUBLISH, REPRODUCE, DISPLAY, PERFORM, ADAPT, MODIFY, DISTRIBUTE, HAVE DISTRIBUTED AND PROMOTE SUCH CONTENT IN ANY FORM, IN ALL MEDIA NOW KNOWN OR HEREINAFTER CREATED, ANYWHERE IN THE WORLD, FOR ANY PURPOSE.
C. Voting Period:
Starting Monday, February 8, 2010 and ending on or about 10 AM (EST) February 12th, 2010, listeners will have the opportunity to go to bob933.com and vote for their favorite photo. Only one vote per day, per IP address will be allowed. Listeners will vote for the top ten finalists. The grand prize winner will receive one (1) tanning package to Golds Gym of Jacksonville, NC, one (1) spa package including: a pedicure, manicure, and facial courtesy of Deluxe Day Spa of Jacksonville, NC, flowers and sash provided by Hooligans Pub and Music Hall.
The grand prize winner will announced live at Hooligans Pub and Music Hall February 13th, 2010. Must be present to win.
Judging criteria voters should use for the contest is based on the following:
· Camera friendly nature of the subject
· Originality
· Photo Quality
Voting is limited to one entry per IP address per day. If an entrant receives multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source, the Station reserves the right to disqualify the finalist in its sole discretion.
D. How to Win:
At the conclusion of the voting period, the Station will select the ten finalists based on the photos that received the most votes. The ten photos will be submitted to the judges provided by HooligansMusic Hall. The top five (5) finalists chosen by the HooligansMusic Hall judges will then compete for the grand prize based on crowd participation/response at Hooligans Pub and Music Hall, 2620 Onslow Dr, JacksonvilleNC February 13th at approximately 11 PM Est.
In the event of two or more contestants have the same crowd response; HooligansMusic Hall will select a panel of judges to select the grand prize winner based on the judging criteria, listed above. All decisions of the judges will be final.
2. Prize(s). The prize(s) that may be awarded to the eligible winner(s) are:
a. one(1) three month membership including tanning to Gold’s Gym of Jacksonville, NC
b. one (1) spa package including a manicure, pedicure and facial at Deluxe Day Spa, JacksonvilleNC
c. one (1) gift certificate to Designer Tan on Jacksonville, NC amount TBD
Prizes are not transferable, or exchangeable for any other prize. All prizes must be claimed the day of the giveaway.
3. Eligibility and Limitations. Participants and winner(s) must be legal U.S. residents and provide proper identification as determined by the Company and reside in the Station’s Total Survey Area (TSA). Entrants must be 18 years of age or older to participate. One entry per person. Only one(1) prize per household for the Contest. Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
If the contest includes the use of an internet tool and the internet voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, the Company reserves the right to select a panel of judges to select the winner(s). All decisions of the judges are final.
5. Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
6. Release. By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
7. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
8. Conduct and Decisions. By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWSAND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Miscellaneous. Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, visit the business office of the Station during normal business hours or mail a written request with a stamped, self-addressed return envelope to the Station’s address, listed above. All entries become the property of the Company and will not be returned.
10. Compliance with Law. The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
